1. About These Terms

These Terms of Use (“Terms”) govern your access to and use of the websites, booking flows, and services provided by Ofibo Travel (“Ofibo Travel,” “we,” “us,” or “our”), a tour and travel agency. By accessing or using our website(s) or services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Definitions

  • “Services” means our website(s), content, customer support, booking assistance, itinerary planning, and any travel-related services we provide.
  • “Supplier” means third parties that provide travel products/services, including airlines, hotels, tour operators, car rental companies, cruise lines, and activity providers.
  • “Booking” means any reservation request, reservation, purchase, or payment made through our Services.

3. Eligibility and Account Responsibility

You must be legally able to enter into a binding contract to use our Services. You agree that all information you provide is accurate and up to date. If you create an account, you are responsible for maintaining confidentiality of your credentials and all activity under your account.

4. Our Role as an Agency; Supplier Terms

Ofibo Travel acts as an intermediary travel agency. Travel products and services are typically provided by independent Suppliers. Your Booking may also be subject to Supplier terms and policies (including rules on changes, cancellations, refunds, baggage, schedules, and conduct). In case of conflict between these Terms and Supplier terms, Supplier terms may control for the specific travel service.

5. Bookings, Pricing, and Availability

Prices and availability can change at any time and are not guaranteed until confirmed in writing. We are not responsible for errors in pricing, availability, or descriptions displayed due to Supplier updates, technical issues, or human error. If a price or availability issue arises, we may cancel the Booking and issue a refund of amounts paid to us for that Booking (subject to any non-refundable items or Supplier rules).

6. Payments, Fees, and Chargebacks

You agree to pay all charges associated with your Booking, including taxes, fees, and surcharges. Some Bookings may be partially or fully non-refundable. If you initiate a chargeback without first contacting us to resolve the issue, you may still be responsible for amounts owed and any associated costs, and we may suspend your access to the Services.

7. Cancellations, Changes, Refunds, and Credits

Cancellation and change policies vary by Supplier and by fare/class/rate. Many travel purchases are non-refundable or include penalties. Refund timing depends on Supplier processing and payment networks. If travel credits are issued, they may have expiration dates and restrictions. We do not guarantee refunds unless explicitly stated in your confirmation and allowed by Supplier rules.

8. Traveler Responsibilities

  • Documents: You are responsible for passports, visas, transit requirements, entry/exit rules, and any required authorizations.
  • Health & Safety: You are responsible for meeting vaccination/testing/health requirements and assessing travel risks.
  • Timeliness: You must arrive on time for flights, transfers, tours, and activities. Missed departures may be non-refundable.
  • Conduct: You must follow Supplier rules and local laws. Suppliers may refuse service for safety or policy reasons.

9. Travel Insurance

We strongly recommend purchasing travel insurance to cover cancellations, medical emergencies, delays, lost baggage, and other disruptions. You are responsible for evaluating coverage and ensuring it meets your needs.

10. Disruptions, Force Majeure, and Schedule Changes

Travel can be disrupted by events outside our control including weather, natural disasters, strikes, civil unrest, government actions, public health events, Supplier operational decisions, or technical failures (“Force Majeure”). We are not liable for losses caused by Force Majeure. Supplier policies may control whether changes/refunds/credits are available.

11. Limitation of Liability

To the maximum extent permitted by law, Ofibo Travel is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost opportunities, arising out of or related to your use of the Services or any Booking, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Services or any Booking will not exceed the total service fees paid directly to Ofibo Travel for the specific Booking giving rise to the claim (excluding amounts passed through to Suppliers).

12. Supplier Liability and Third-Party Services

Suppliers are responsible for the travel services they provide. We do not control and are not responsible for Supplier acts/omissions, including delays, overbookings, cancellations, quality, safety, or changes in services. Some content or links may direct you to third-party websites; we are not responsible for third-party content or practices.

13. Intellectual Property

The Services and all related content (text, graphics, logos, software, and design) are owned by or licensed to Ofibo Travel and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works without our prior written permission.

14. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes or to violate any law or regulation.
  • Interfere with or disrupt the Services, servers, or networks.
  • Attempt to gain unauthorized access to accounts, systems, or data.
  • Transmit malware, spam, or harmful code.
  • Scrape, harvest, or collect data from the Services without permission.

15. Privacy

Your use of the Services is also subject to our Privacy Policy. If you make a Booking, you authorize us to share necessary information with Suppliers to fulfill your travel arrangements.

16. Complaints and Support

If you have an issue with a Booking, contact us as soon as possible. Many travel issues must be addressed during travel with the Supplier directly (e.g., hotel front desk, airline, tour operator), but we’ll assist where we can.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where Ofibo Travel is established, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the Services will be resolved in the competent courts of that jurisdiction, unless applicable consumer protection laws provide otherwise.

18. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes means you accept the updated Terms.
